Electronic notifications and communications are formal communications from the administration to citizens, companies and entities, electronically, with all legal guarantees.
What is the difference between notification and communication?
- A communication is the sending of information from public administrations to citizens or companies, without access (or not) to its content having legal effects.
- A notification is a formal and personal procedure through which public administrations communicate to a specific person or their legal representatives an administrative resolution that has a direct implication on their rights or interests. Notifications must be carried out in accordance with legal requirements and must allow for a record of their receipt, and of the access, acceptance or rejection of the interested person.
Why am I receiving electronic notifications?
As a citizen, every time you carry out a procedure with the administration, you can select whether you want to receive notifications related to the procedure electronically. You can also receive notifications related to procedures initiated ex officio by the Administration, such as a sanction.
In the case of companies, associations, entities... (legal entities), they are obliged by regulation to receive notifications electronically.
When is an electronic notification considered to have been made?
- When the recipient accesses the notification and expressly accepts its receipt (it will appear as "Open" on the portal).
- When 10 calendar days have passed since the notification was made available (date of delivery thereof) without the recipient having accessed the content, unless the technical or material impossibility of accessing it is proven at their request or ex officio (it will be recorded as "Expired" on the portal).
The electronic notification system allows the date and time of access by the recipient of the notification to be proven (date on which the notification changes to "Open" status), as well as when it is understood to be expressly rejected (date on which the notification changes to "Rejected" status), or due to the passage of the legally established period (date on which the notification changes to "Expired" status).
